Welcome to VirtuFit Pro. These Terms govern your access to and use of our virtual try-on app and related services. By installing or using VirtuFit Pro, you agree to these Terms; if you do not agree, uninstall the app and discontinue use.
1. Overview
VirtuFit Pro enables AI-powered virtual try-on experiences for Shopify stores, allowing customers to preview products inside the storefront.
2. Eligibility
You must have an active Shopify store, be at least 18 years old (or the age of majority), and have authority to bind your business to these Terms.
3. Account & Access
Installing the app creates a secure connection between your store and VirtuFit Pro. You are responsible for safeguarding any credentials used to access the dashboard.
4. App Usage & License
We grant a limited, non-transferable, revocable license to use the app solely for operating your Shopify store. You agree not to reverse-engineer, misuse, or upload prohibited content.
5. Pricing & Billing
Plans and usage limits are displayed in the app and Shopify listing. Paid subscriptions are billed via Shopify; overages incur additional fees. All charges are non-refundable except where required by law.
6. Intellectual Property
VirtuFit Pro retains ownership of its software, design, and trademarks. You retain ownership of your store content but grant us the right to process it solely to deliver the Service.
7. Data & Privacy
We process store and personal data according to our Privacy Policy. Uploaded shopper images are used only to generate try-on results and are deleted immediately.
8. Service Availability
We strive for continuous uptime but cannot guarantee it. Maintenance or third-party outages may affect features; we are not liable for resulting losses.
9. Termination
You may uninstall at any time. Upon uninstallation, access ends and data is deleted within 30 days, though fees accrued remain payable. We may suspend service for violations.
10. Limitation of Liability
VirtuFit Pro is provided "as is". We disclaim warranties and are not liable for indirect or consequential damages. Our maximum liability is the fees paid in the past six months.
11. Indemnification
You agree to indemnify VirtuFit Pro against claims arising from your use of the Service, violation of these Terms, or infringement of others' rights.
12. Changes
We may update the Service or Terms; significant changes will be announced via email or in-app notices. Continued use constitutes acceptance.
13. Governing Law
These Terms are governed by the laws of the jurisdiction where VirtuFit Pro operates, without regard to conflict of law principles.
